Land Identification and Boundary Verification.
The first step of land due diligence exercise is the land identification process involves confirming the physical location of the property and confirm that it indeed corresponds to relevant survey documents filed at Survey of Kenya and the Land Ministry records. We also check to see if the property sits on public land, riparian land, water reserve or freight path. We also check if the property is subject to flood risk per the relevant land laws.
Title Deed Investigation
Title deed investigation involves checking the historical background of the property to find out if the property was genuinely acquired. We also check if the property has any cautions, encumbrances or caveats and also confirm the registered proprietor for the property. Further to that, we check if the property is subject to any succession or compulsory acquisition.
Seller Verification
Seller verification involves that the person indeed selling the land is authentic, legitimate and not fraudulent. This is done for individual and corporate sellers.
Valuation
In order to justify the price incase of purchase, we advise all our clients to conduct a property valuation exercise in order to ascertain the property is sold at the correct price and that they are not overcharged. The valuation service is not part of land due diligence but it is highly advised.
